CHerRoof Terms of Service Document ID: CHERROOF-TERMS Version: 1.0 Effective date: August 9, 2026 Approval status: Owner-approved interim version; not reviewed by legal counsel Provider: Cherrera Sales LLC, doing business as CHerRoof Mailing address: 300 Lakefront Dr, Apt. 5208, Little Elm, TX 75068 Support email: support@cherroof.com Governing state: Texas 1. Agreement and Eligibility These Terms govern access to and use of the CHerRoof mobile and web applications and related services. By creating an account or using CHerRoof, a user agrees to these Terms and the CHerRoof Privacy Policy. A user who does not agree must not use CHerRoof. CHerRoof accounts are intended for people who are at least 18 years old and able to enter a binding agreement. A person using CHerRoof for a business represents that they are authorized to act for that business. 2. What CHerRoof Provides CHerRoof provides a homeowner-first record of documented roof conditions. Depending on the user's authorized role, the service may support property and roof records, inspection requests, inspection documentation, photographic evidence, review, published reports, repair or replacement records, and historical versions. CHerRoof reports document visible conditions and information available at the time of an inspection. CHerRoof does not replace a structural engineer, a licensed professional when a license is legally required, an insurance carrier or coverage determination, legal advice, code-enforcement review, a warranty, or a guarantee of future roof performance. Conditions may change after an inspection. Storm exposure alone does not confirm damage or insurance coverage. 3. Accounts and Authorization Users must provide accurate registration information, protect their credentials, and promptly report suspected unauthorized access. Email verification and current authorization may be required for protected actions. Adding a property address creates an access claim; it does not prove legal ownership. CHerRoof may review duplicate-address claims and property-access disputes and may restrict access while a review is pending. Inspector and Operations access is controlled separately. A user may not obtain, grant, or represent an internal role without CHerRoof authorization. Any displayed license, certification, affiliation, or professional qualification is shown only when CHerRoof has verified that specific claim. 4. Acceptable Use Users may not misuse the service, attempt to access another person's records, bypass security controls, impersonate another person, upload content they lack permission to use, interfere with the service, introduce malicious code, or use CHerRoof for unlawful or fraudulent activity. Users must not treat CHerRoof content as an insurance decision, structural certification, code-compliance certification, or guarantee. 5. User Content and Permissions Users retain their rights in information and images they submit. They grant Cherrera Sales LLC the limited permission needed to host, process, reproduce, display, secure, and retain that content to operate CHerRoof, provide authorized records, investigate disputes, maintain audit history, and comply with law. A user must have the right to submit the content. CHerRoof will not use unlicensed map or aerial imagery as inspection evidence. 6. Reports, Evidence, and History Published reports are private, in-app records tied to the property, roof, inspection, evidence, and visualization version from which they were created. Reports and evidence may contain incomplete or unknown information. “Unknown” is a valid condition and must not be interpreted as healthy. Published reports and their historical references are preserved and are not silently overwritten. Corrections create linked versions. Confirmed repairs and replacements preserve earlier history. Access remains subject to current authorization. 7. No Emergency Service CHerRoof is not an emergency service. If a roof condition may create an immediate danger to people or property, users should leave the unsafe area and contact appropriate emergency services or qualified professionals. 8. Service Availability and Changes CHerRoof may experience maintenance, interruptions, delayed uploads, or unavailable features. Cherrera Sales LLC may make changes needed for security, legal compliance, reliability, or the approved CHerRoof product scope. Material changes to these Terms will receive a new version and effective date and any notice required by law. 9. Suspension and Account Deletion CHerRoof may suspend or restrict access when reasonably necessary to protect users, investigate fraud or access disputes, address security risks, enforce these Terms, or comply with law. Every account holder may initiate account deletion from Account → Delete account or at https://cherroof.com/account-deletion. CHerRoof verifies the request and uses support review because published reports, registered evidence, property history, security records, and audit history may have continuing integrity or legal obligations. Processing removes login access and unnecessary personal identifiers, revokes roles and property memberships, and preserves only the record classes described in the Privacy Policy. A user may cancel before processing begins and may appeal a denial or partial result. 10. Disclaimers TO THE EXTENT PERMITTED BY LAW, CHERROOF IS PROVIDED “AS IS” AND “AS AVAILABLE.” CHERRERA SALES LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT A REPORT IDENTIFIES EVERY EXISTING OR FUTURE CONDITION. NOTHING IN THESE TERMS EXCLUDES RIGHTS OR WARRANTIES THAT CANNOT LEGALLY BE EXCLUDED. 11. Limitation of Liability TO THE EXTENT PERMITTED BY LAW, CHERRERA SALES LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF CHERROOF. THIS SECTION DOES NOT LIMIT LIABILITY OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE LIMITED. This interim version intentionally does not impose an arbitration agreement, class-action waiver, or separate contractual liability cap. 12. Governing Law and Disputes These Terms are governed by the laws of Texas, without regard to conflict-of-law rules. Unless applicable law gives a consumer the right to proceed elsewhere, disputes may be brought in a court with jurisdiction in Denton County, Texas. Either party may use an eligible small-claims court. These Terms do not require private arbitration and do not waive participation in a class action where that right exists under applicable law. 13. Contact Questions about these Terms may be sent to support@cherroof.com or mailed to 300 Lakefront Dr, Apt. 5208, Little Elm, TX 75068.
